Senator Pat Toomey is on the fence regarding how he will ultimately vote during the impeachment trial. While Toomey ultimately voted that holding a trial for a former president is constitutional it’s unclear if he will ultimately vote to convict. However, the odds are not in Trump’s favor as Sen. Toomey has previously made statements blaming Trump for the violence at the Capitol on Jan. 6th and supported his resignation.

Sen. Toomey made this statement on the constitutionality of the impeachment trial:

“President Trump will be out of office before a Senate impeachment trial can begin. Whether or not the Senate has the constitutional authority to hold an impeachment trial for a president that is no longer in office is debatable. Should the Senate conduct a trial, I will again fulfill my responsibility to consider arguments from both the House managers and President Trump’s lawyers.”
