Capitol Rioter Sentenced after Assaulting Capitol Police Officer

New Jersey gym owner Scott Fairlamb was sentenced to more than three years in prison on Wednesday for his violent role in the Capitol riot.  

Fairlamb, 44, pleaded guilty to obstruction of an official proceeding and assaulting the police officer. “Had you gone to trial, I don’t think there’s any jury that could have acquitted you or would have acquitted you,” the judge remarked.

The former mixed martial arts fighter apologized for his “irresponsible” and “reckless” actions. “I take full responsibility for what I did that day,” he said in court. “That’s not who I am. That’s not who I was raised to be.” 

Fairlamb busted through barricades and police officers to get into the West Terrace of the Capitol on Jan. 6. He videotaped himself screaming, “What (do) patriots do? We f——— disarm them and then we storm the f——— Capitol!”  

Upon exiting the building, he went after a group of Metropolitan Police, shoving one officer and punching him in the face shield. In another video filmed two days later, prosecutors said Fairlamb touted that “they pulled the pin on the grenade, and the blackout is coming. What a time to be a patriot.”  

Prosecutors argued that the ex-MMA fighter was “well aware” of the kind of injuries he could cause with his fists. “He was trained to throw a punch.” They also insisted that the judge fine him because he allegedly solicited $30,000 in donations and it was “not right” for Fairlamb to profit off the Capitol riot.

They recommended a sentence of 44 months, but the defense argued for “time-served” since he has been in custody for the last 11 months. The judge handed down a 41-month prison sentence, three years of supervised release, and a $2,000 fine.   

Fairlamb’s sentence is the longest any of the 32 Capitol rioters already charged have received, he was also the first person who assaulted a police officer to be sentenced. More than 100 people are accused of attacking law enforcement officials on January 6th.
