Trial Date Request
Former U.S. President Donald Trump is actively seeking to defer the commencement of his federal trial in Washington, D.C., concerning his purported attempts to reverse the 2020 presidential election results. His legal team has filed a request to delay the trial until April of 2026.
This move is in response to Special Counsel Jack Smith’s team, who requested that the jury selection begin in December 2023 and the trial in January 2024. They argue that the prompt start date would satisfy the public’s interest in a swift trial, particularly in this significant case involving a former president.
Earlier this month, an indictment was brought against Trump on a range of charges, including but not limited to, Conspiracy to Defraud the United States, Conspiracy to Obstruct an Official Proceeding, and Obstruction of and Attempt to Obstruct an Official Proceeding.
The indictment alleges that despite losing the election, Trump persistently spread false information about the election outcome, thereby creating an intense national atmosphere of mistrust and anger – which appears to be under Trump’s first amendment rights to do, as “creating an intense national atmosphere of mistrust and anger” is not deemed unlawful. The indictment further underscores that the charges pertain to specific actions rather than exclusively encompassing unfounded assertions or legal challenges.
U.S. District Judge Tonya Chutkan, who was appointed by President Obama, is overseeing the case. She has emphasized her commitment to impartiality and has made it clear that she will not show any special treatment to Trump or allow political biases to affect the trial.
This was evident when she chose to refer to Trump as “Mr. Trump” instead of the customary “President Trump,” a formality extended to both current and past presidents. Despite her past donations to President Barack Obama’s campaigns, she maintains that Trump’s presidential campaign should be regarded as a regular occupation.
Judge Chutkan asserts that Trump will be held to the same legal standards as any low-level typical criminal facing charges, as she strives to ensure President Trump is fighting an uphill and political battle at every turn.
