Trump Lawsuit Dismissal

A lawsuit arguing that Donald Trump should not appear on the Florida primary ballot due to the events of January 6, 2021, was dismissed by Judge Robin Rosenberg, an appointee of Barack Obama. The judge ruled that the plaintiffs, including Boynton Beach attorney Lawrence Caplan, lacked ‘standing’ to bring the challenge. The ruling stated that “Plaintiffs lack standing to challenge Defendant’s qualifications for seeking the Presidency,” and “the injuries alleged” from January 6, 2021, “are not cognizable and not particular to them.”

Additionally, the judge noted that an individual citizen does not have standing to challenge another individual’s qualification to hold public office.

14th Amendment Argument

Lawrence Caplan argued that the 14th Amendment, which was ratified after the Civil War, prohibits Trump from running again. The amendment states that no person shall hold office if they have engaged in insurrection or rebellion against the United States or given aid or comfort to its enemies.

Caplan claimed that the facts of the indictment against Trump matched closely with the amendment. However, various attempts by liberal activists to use the 14th Amendment to disqualify Republicans from the ballot have been unsuccessful, as seen in the cases of former GOP Rep. Madison Cawthorn and GOP Rep. Marjorie Taylor Greene.

Ongoing Legal Efforts

Despite the dismissal in Florida, efforts to keep Trump off the ballot using the 14th Amendment continue. The New Hampshire attorney general’s office is reviewing arguments to keep Trump off the ballot, and two activist groups have initiated legal efforts to exclude Trump from the ballot in five states: California, Colorado, Georgia, Oregon, and Nevada. Trump faces two indictments related to January 6, one federal and one in Georgia, which activists hope will strengthen their 14th Amendment argument.
