Nebraska Senator and Trump critic Ben Sasse is predicting the Supreme Court will refuse to hear the lawsuit brought forward by Texas against the battleground states Georgia, Michigan, Wisconsin, and Pennsylvania. The Nebraska Republican called the lawsuit a “PR stunt” that will quickly be shot down by the Supreme Court.

Earlier this week, Texas filed a lawsuit alleging that the four battleground states used the Covid-19 pandemic to justify ignoring federal and state election laws to implement last-minute changes to the mail-in election process. These changes ultimately were to the benefit of Democrat Joe Biden. The suit seeks to invalidate the 62 electoral votes made up by the Defendant states resulting in President Trump winning a second term in the White House.

“I’m no lawyer but I suspect the Supreme Court swats this away,” Sasse said in a statement.

“From the brief, it looks like a fella begging for a pardon filed a PR stunt rather than a lawsuit – as all of its assertions have already been rejected by federal courts and Texas’s own solicitor general isn’t signing on,” the Nebraska Republican said.

Eighteen states joined the lawsuit, filed Monday in the Supreme Court by Texas Attorney General Ken Paxton, which seeks to block presidential electors in four battleground states from casting their votes for Biden.

On Wednesday, the attorneys general of seventeen states Trump won last month filed an amicus brief in the case. The red states that joined that brief are Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, and West Virginia.

Senator Sasse has been a longtime critic of President Trump, the Nebraska Republican recently criticized Trump’s behavior for foreign policy on a town hall call with constituents. Sasse was also one of the first Republicans to refer to Biden as President-elect.
