Historically, Barrett has sided with the Trump administration on immigration. In the case of Cook County v. Wolf, Barret supported the Trump Administration’s “public charge” a rule which prohibits immigrants that are likely to use welfare from getting visas. Barrett called it a “policy choice” that shouldn’t be resolved in litigation. In the case of Yafai v. Pompeo Barrett also sided with the State Department’s decision to deny an American citizen’s wife a visa after she attempted to smuggle children into the U.S. despite the fact the parents said their child had passed away. The case was reconsidered and the wife was not given a visa. Barrett supported Pompeo saying that the State Department had met its legal requirements by reconsidering the case. “[A higher] standard may be desirable but imposing it would be inconsistent with Supreme Court precedent,” Barrett wrote. “The Supreme Court has repeatedly held that a citation to a statutory provision suffices to show a legitimate and bona fide reason for denying a visa application. It is free to revisit that precedent, but we are not.”
