Former President Trump signed Executive Order 13891- Promoting the Rule of Law Through Improved Agency Guidance Documents which Biden revoked on Inauguration Day. Trump’s order affirmed “Congress’s lone authority for lawmaking by prohibiting federal agencies from issuing binding rules through guidance documents-unless explicitly authorized” and also required additional transparency when issuing the guiding documents.
