A recently surfaced audio recording from 2021 is claimed to contradict former President Donald J. Trump’s recent statement regarding his reference to news clippings rather than classified documents. The recording, publicly aired by CNN, has raised suspicions about how it was obtained and is believed to capture a conversation involving Trump and others discussing a “highly confidential” document concerning Iran. Trump mentioned his inability to declassify the document due to no longer holding office.
The present situation revolves around the media’s utilization of this audio recording, which supposedly features Trump discussing Iran and has some connection to the charging document against him. However, the specific charge relating to the audio remains unclear or absent, as Trump was not charged in relation to the Iran memo.
Trump criticized “deranged Special Prosecutor Jack Smith” and expressed his allegations against the DOJ and FBI, accusing them of intentionally leaking the tape for media sensationalism. Taking to Truth Social, Trump further stated:
“The Deranged Special Prosecutor, Jack Smith, working in conjunction with the DOJ & FBI, illegally leaked and “spun” a tape and transcript of me which is actually an exoneration, rather than what they would have you believe. This continuing Witch Hunt is another ELECTION INTERFERENCE Scam. They are cheaters and thugs!”
The recording, presented without a definitive context, implies that Trump was referring to specific papers in front of him rather than relying on secondhand accounts. This recording could serve as evidence in Trump’s trial concerning charges of mishandling classified documents and obstructing government efforts to recover them.
However, the authenticity and truthfulness of the recording may be disputed depending on how it was obtained. If Trump’s claim is accurate and Jack Smith, along with the FBI and/or DOJ, deliberately released the tape to tarnish Trump’s reputation, they would themselves be committing a crime. Such actions could potentially taint the jury pool and give rise to various offenses, including contempt of court, unauthorized disclosure of confidential information, or breach of duty/official misconduct. Consequently, from a legal standpoint, there is a possibility of a mistrial since it will be challenging to ascertain who has been exposed to the leaked evidence propagated by CNN.
