Rep. David N. Cicilline (D-RI), and a total of forty-one Democrats introduced legislation to ban Trump from ever holding a federal office again. Rep. Cicilline, the author of the legislation, was both the senior member of the House Committee on the Judiciary, and former impeachment manager.
Rep. Cicilline wrote:
“Donald Trump very clearly engaged in an insurrection on January 6, 2021 with the intention of overturning the lawful and fair results of the 2020 election. You don’t get to lead a government you tried to destroy,” adding, “Even Mitch McConnell admits that Trump bears responsibility, saying on the Senate floor that ‘[t]here’s no question, none, that President Trump is practically and morally responsible for provoking the events of the day.’ The 14 Amendment makes clear that based on his past behavior, Donald Trump is disqualified from ever holding federal office again and, under Section 5, Congress has the power to pass legislation to implement this prohibition.”
The legislation is either poorly timed, or Democrats were aware that there was no basis to begin with, as the GOP just took back the House of Representatives, and this bill was introduced after the 2022 Midterm elections.
Arguments are still being made as to whether January 6th was an intersection or not, and now over two years later there is no tangible threat to the United States government. January 6th was a protest that got out of hand, not a genuine attempt to overthrow the government.
